The law
#Peru applies the arm's length principle through item 4 of art. 32 and art. 32-A of the Income Tax Law (LIR, TUO approved by DS 179-2004-EF) and Chapter XIX of its Regulation (DS 122-94-EF, arts. 108 to 119). The rules cover transactions with related parties, transactions made from, to or through low or no tax or non-cooperative jurisdictions, and transactions with persons under a preferential tax regime. Parties are related mainly by more than 30% of capital, common directors, consolidated accounts or dominant influence (Regulation art. 24). SUNAT can adjust a price only if it gives less Peruvian tax, or if the change gives more Peruvian tax on dealings with other related parties (art. 32-A(c)). The OECD Transfer Pricing Guidelines are used to interpret the article if they do not conflict with the law (art. 32-A(h)). Services from related parties are deductible only if the taxpayer passes the benefit test and gives the requested support (art. 32-A(i)).
Documentation
#There are three annual information returns filed on SUNAT systems. The Local Report (Form 3560) is due from taxpayers with income above 2,300 UIT and related party transactions of at least 100 UIT. The simple version applies below 400 UIT, and the full version with the transfer pricing analysis applies from 400 UIT, or for any sale of goods below cost (RS 014-2018/SUNAT art. 2). The Master Report (Form 3561) is due from a group member whose own income in the year is above 20,000 UIT and whose related party transactions are at least 400 UIT (RS 163-2018/SUNAT art. 2). The Country-by-Country Report is due from a Peruvian parent, or a designated or required Peruvian member, when group income in the prior year is S/ 2.7bn or more, and is filed in the IR AEOI system (RS 188-2019/SUNAT). The UIT is the one for the year being reported (Regulation art. 116(a)(7)): S/ 5,150 for 2024, S/ 5,350 for 2025 and S/ 5,500 for 2026. Supporting documents must be kept, with a Spanish translation if needed, for 5 years or the limitation period, whichever is longer (art. 32-A(g)). The old Technical Study duty was replaced by these reports.
Methods
#The law lists six methods: comparable uncontrolled price, resale price, cost plus, profit split, residual profit split and transactional net margin. The taxpayer must use the one most appropriate to the economic reality of the transaction (art. 32-A(e); Regulation art. 113). Since 1 January 2025 (DL 1663), other methods such as discounted cash flow, multiples, equity value, appraisal or MPEEM can be used if the six methods do not fit, backed by a technical report built on the International Valuation Standards (Regulation art. 113-B, added by DS 302-2025-EF from 18 December 2025). A range is built when there are two or more comparables, using the interquartile method. If the agreed value is inside the range it is accepted. If it is outside the range and gives less Peruvian tax, the market value is the median (Regulation art. 114). Special rules apply to exports and imports of goods with a known market quote: the quote date is the one the taxpayer tells SUNAT on time, or else the end of loading or unloading (art. 32-A(e)(1); Regulation art. 113-A).
Penalties
#Fines are in Tax Code Table I and are often a share of IN, which means net revenue (net sales and other income shown in the prior year's annual return, art. 180(b)), not profit. Filing the Local, Master or Country-by-Country Report late is fined 0.6% of IN, with a floor of 10% of one UIT and a cap of 25 UIT (art. 176 item 2, Table I notes 10 and 14). Filing one that is incomplete or untrue carries the same fine (art. 176 item 4). Not producing the transfer pricing documents SUNAT asks for is also fined 0.6% of IN with the same limits (art. 177 item 27). Declaring false data that lowers the tax carries a fine of 50% of the tax omitted (art. 178 item 1), and a late annual return is fined 1 UIT (art. 176 item 1). SUNAT can assess for 4 years, or 6 years if no return was filed (art. 43). Fines can be reduced under SUNAT's gradual penalty rules (art. 166), which were not reviewed.
Pillar Two
#Peru has not adopted Pillar Two. No income inclusion rule, undertaxed profits rule or domestic minimum top-up tax was found in the Income Tax Law, its Regulation or any SUNAT rule, and no GloBE return, registration or top-up tax deadline exists. The general corporate tax rate is 29.5% (LIR art. 55). Peruvian subsidiaries of groups with revenue of EUR 750m or more may still be affected by the rules of the parent's country.
Other rules
#The annual corporate income tax return (Form 710) for the calendar year is due in March and April, by the last digit of the RUC (the tax number). Micro and small businesses (MYPE) with income up to 1,700 UIT get May and June dates under Law 31940, but not a MYPE that is part of a group where one member controls another, so group members normally use the March and April dates. SUNAT publishes each year's schedule in late December. SUNAT can sign advance pricing agreements with Peruvian taxpayers and with treaty partners (art. 32-A(f), changed by DL 1662 from 1 January 2025). A taxpayer with an APA files the annual APA report on the same date as the Local Report (RS 377-2013/SUNAT art. 18.1, as changed by RS 014-2018). A Peruvian member of a multinational group that is a designated or required CbC filer must tell SUNAT who files, by the last working day of the month before the filing month (RS 163-2018 art. 10.2).
Filings and deadlines
#| # | Filing | When | Who | Source |
|---|---|---|---|---|
| 1 | Annual income tax return (Declaración Jurada Anual del Impuesto a la Renta, Form 710) Due on the date SUNAT sets each year by the last digit of the RUC. For the 2025 tax year the dates run from 26 March 2026 (digit 0) to 10 April 2026, and 13 April 2026 for good taxpayers (RS 000386-2025/SUNAT art. 6). For 2024 they ran from 26 March 2025 (digit 0) to 8 April 2025, and 9 April 2025 for good taxpayers (RS 000304-2024/SUNAT art. 6). The site shows the earliest date, for RUC digit 0. MYPE with income up to 1,700 UIT that are not part of a controlled group, and individuals, file later under Law 31940: 26 May to 9 June 2025, and 27 May to 10 June 2026. The schedule for 2026 has not been published, so no date is shown for December 2026. A return filed late is fined 1 UIT (Tax Code art. 176 item 1). The tax is also paid on these dates. | SUNAT annual schedule, RUC ending in 0 (earliest) (e.g. Mar 26, 2026) | All companies liable to Peruvian corporate income tax (third category income). Micro and small businesses (MYPE) with income up to 1,700 UIT in the prior year use a later schedule (May and June), but MYPE that control or are controlled by other businesses are left out, so members of a multinational group normally use these dates. | RS 000386-2025/SUNAT, annual return schedule for tax year 2025 (SUNAT) |
| 2 | CbC filer designation notice to SUNAT (Comunicación de designación, annex II) The designated Peruvian member must tell SUNAT by the last working day of the month before the month in which the report is due (RS 163-2018 art. 10.2). The report is due in October, so the notice is due by 30 September. It is sent as a scanned annex II to fiscalizacioninternacional@sunat.gob.pe. If it is not sent, all Peruvian members of the group are treated as responsible (art. 10.3). A Peruvian member that is excused because the group files through a representative parent abroad must tell SUNAT in writing by the report deadline, with a copy of the foreign notice (art. 11.2). The month is read from the October filing month, which the rule does not state outright. | Last working day of September (e.g. Sep 30, 2026) | Only a Peruvian member of a multinational group with income of S/ 2.7bn or more in the prior year, when the Peruvian parent is not the filer: a member named as representative parent, or a member that must file because the foreign parent does not file, has no exchange agreement with Peru or fails systematically (RS 163-2018 art. 10.1.2; Regulation art. 116(b)). Not needed if the Peruvian entity is the ultimate parent. | RS 163-2018/SUNAT arts. 10 and 11 (SUNAT) |
| 3 | Master Report information return (Reporte Maestro, Form 3561) Due with the monthly schedule for the September period of the next year, which falls in October (RS 163-2018 art. 8). For 2024 that was 16 October 2025 (digit 0) to 24 October 2025 (good taxpayers). For 2025 it is 16 October 2026 (digit 0) to 26 October 2026 (good taxpayers). The site shows the earliest date, for RUC digit 0. Filed in SUNAT Operaciones en Linea with a PDF file under annex I of the resolution. A form that fails the checks counts as not filed. No extension was found in SUNAT's 2026 resolution list up to RS 000209-2026 of 23 October 2026, so the 2025 report was due on 16 October 2026 for digit 0. Late filing is fined 0.6% of net revenue (Tax Code art. 176 item 2, Table I note 14). The schedule for 2026 has not been published. | SUNAT monthly schedule, September period, RUC ending in 0 (earliest) (e.g. Oct 16, 2026) | Group members whose own income accrued in the year is above 20,000 UIT and that had related party or low tax jurisdiction transactions of at least 400 UIT (RS 163-2018/SUNAT art. 2). The income limit is S/ 103,000,000 for 2024, S/ 107,000,000 for 2025 and S/ 110,000,000 for 2026. The tool tests income above the lowest of these (S/ 103,000,000), so it can flag companies under the limit for later years or below the 400 UIT transaction limit. | RS 163-2018/SUNAT arts. 2 and 8 (SUNAT) |
| 4 | Country-by-Country Report (Reporte País por País, IR AEOI system) Due with the monthly schedule for the September period of the next year, which falls in October (RS 163-2018 art. 17). For 2024 that was 16 October 2025 (digit 0) to 24 October 2025 (good taxpayers). For 2025 it is 16 October 2026 (digit 0) to 26 October 2026 (good taxpayers). The site shows the earliest date, for RUC digit 0. It is filed as XML in the IR AEOI system at aeoi.sunat.gob.pe, not in Form 3562, which was withdrawn on 1 October 2019 (RS 188-2019/SUNAT). A Peruvian member need not file if the group has filed through a representative parent abroad whose country meets the exchange conditions, by the deadline or earlier (Regulation art. 116(b)). SUNAT cannot adjust prices based only on this report (art. 32-A(g)). No extension was found in SUNAT's 2026 resolution list up to 23 October 2026. Late filing is fined 0.6% of net revenue (Tax Code art. 176 item 2, Table I note 14). | SUNAT monthly schedule, September period, RUC ending in 0 (earliest) (e.g. Oct 16, 2026) | A Peruvian parent of a multinational group with consolidated income of S/ 2.7bn or more in the prior year, and a Peruvian member when the foreign parent does not file, has no exchange agreement with Peru or fails systematically, or the member was named representative parent (Regulation art. 116(b); RS 163-2018 art. 10). The threshold is met at exactly S/ 2.7bn. | RS 163-2018/SUNAT art. 17 and RS 188-2019/SUNAT (SUNAT) |
| 5 | Local Report information return (Reporte Local, Form 3560) Normally due with the monthly schedule for the May period of the next year, which falls in June (RS 014-2018 art. 9). For 2024 that was 16 June 2025 (digit 0) to 24 June 2025 (good taxpayers). For 2025, RS 000113-2026/SUNAT (El Peruano, 14 June 2026) moved it for all filers to the October 2026 period, so 16 November 2026 (digit 0) to 24 November 2026 (good taxpayers), because Form 3560 is being updated for DL 1663. The site shows the earliest date, for RUC digit 0. The schedule for 2026 has not been published. Between 100 and 400 UIT the simple version applies (annex I); from 400 UIT, or for any sale of goods below cost, the full version with the analysis and files applies. State companies and individuals not earning third category income are excluded (art. 3). Late filing is fined 0.6% of net revenue (Tax Code art. 176 item 2, Table I note 14). The annual APA report is filed on the Local Report date (RS 377-2013 art. 18.1); RS 000113-2026 does not say whether its extension also covers that report. | SUNAT monthly schedule, RUC ending in 0 (earliest) (e.g. Nov 16, 2026) | Taxpayers within the transfer pricing rules whose income accrued in the year is above 2,300 UIT, with related party or low tax jurisdiction transactions of at least 100 UIT, or any sale of goods below cost (RS 014-2018/SUNAT art. 2). The UIT is the one for the year reported, so the income limit is S/ 11,845,000 for 2024, S/ 12,305,000 for 2025 and S/ 12,650,000 for 2026. The tool tests income above the lowest of these (S/ 11,845,000) so that no year is missed; it can flag companies under the limit for 2025 or 2026, or whose transactions are below 100 UIT. | RS 000113-2026/SUNAT, extension of the 2025 Local Report (SUNAT) |
| 6 | Transfer pricing support documents requested by SUNAT The documents and information behind the reports must be kept for 5 years or the limitation period, whichever is longer, with a Spanish translation if needed (LIR art. 32-A(g)). They must be produced in the form and time SUNAT sets in its request. If other methods are used, the technical report must be handed over when SUNAT requests it (art. 32-A(e)(7.2)(d); Regulation art. 113-B). Not producing them is fined 0.6% of net revenue (IN), with a floor of 10% of one UIT and a cap of 25 UIT (Tax Code art. 177 item 27). The time limit is in SUNAT's request and was not set in the law pages read. | See note | Any taxpayer within the transfer pricing rules, when SUNAT asks for the documents in an audit or requirement. | LIR art. 32-A(g) and Tax Code art. 177 item 27 (SUNAT) |
