The law

#

The Isle of Man has no transfer pricing statute and no written arm's length rule in its domestic law that could be confirmed from an official source. The Income Tax Act 1970 is the main tax law. Tax advisers describe only a general power for the Assessor of Income Tax to counter transactions whose main purpose is to avoid tax (PwC summary, not official). The arm's length principle reaches the island mainly through its tax treaties, which follow OECD Model Article 9. The Income Tax (Country-by-Country Reporting) Regulations 2017 (SD 2017/0091) say the Assessor uses CbC reports to judge transfer pricing risk, and that transfer pricing adjustments will not be based on the CbC report alone. The standard company tax rate is 0%, so most local transfer pricing risk is low, but 10% (banking, large retail) and 20% (income from Isle of Man land and property) rates apply to some income.

Documentation

#

There is no master file, local file or transfer pricing documentation rule in Manx law, and no deadline or threshold for one. Companies must keep normal accounting and tax records. Country-by-Country reporting is the only transfer pricing style filing: groups with consolidated revenue of EUR 750m or more in the prior year file a CbC report through the online Information Provider Service. Economic substance reporting is part of the company tax return for companies with income from a relevant sector.

Methods

#

No methods are prescribed in Manx law. In practice the OECD Transfer Pricing Guidelines are the usual reference, but no official Isle of Man page adopts them. The island does not offer advance pricing agreements (tpcases.com profile citing the OECD, not official).

Penalties

#

There are no transfer pricing penalties. For CbC: a GBP 300 penalty for failing to comply with any duty, then up to GBP 60 a day after notice (the Income Tax Commissioners can raise this, up to GBP 1,000 a day after 30 days), and up to GBP 3,000 for inaccurate information that is deliberate or left uncorrected (SD 2017/0091 regs 11 to 13 and gov.im guidance). Late company returns bring a first fixed penalty (GBP 250 according to Division notices) and a second penalty if the return is still missing 6 months after the due date. Late payment carries interest from the due date. Pillar Two penalties are in the table in the Pillar Two section below and in articles 50 to 58 of the Order.

Pillar Two

#

The Global Minimum Tax (Pillar Two) Order 2024 (SD 2024/0234, approved by Tynwald 21 November 2024) applies to fiscal years starting on or after 1 January 2025. It enacts a 15% Domestic Top-up Tax (DTUT, a qualified domestic minimum top-up tax) and a Multinational Top-up Tax (MTUT, a qualified income inclusion rule that mainly hits Manx parents). It does not enact the UTPR (article 3 of the Order says so). Groups with consolidated revenue of EUR 750m or more in at least two of the last four years are in scope, with a de minimis exclusion. Each group appoints a Domestic Filing Entity (DFE), which registers the group's Manx entities and files for it. Registration is due 12 months after the start of the group's first fiscal year beginning on or after 1 January 2025 (article 29); the Division's Pillar 2 page says the deadline is not earlier than 1 January 2026. The DTUT return, MTUT return, GloBE Information Return (or a notification that it was filed elsewhere) and the below-threshold notification are all due 15 months after the fiscal year end, or 18 months for a group's first liable year if it has not had to file a GloBE Information Return anywhere else in an earlier year (article 36). DTUT and MTUT are payable on the same date (article 59). For a 31 December 2025 year end the first date is 31 March 2027. Amendment Orders in 2025 and 2026 made enrolment in the online Pillar 2 Service compulsory for the DFE and added the OECD Side-by-Side package (SD 2026/0127, effective 24 July 2026). The Division is still building the online function for DTUT and MTUT returns.

Other rules

#

Under section 49(2) of the Interpretation Act 2015, when the day by which something must be done, or the last day of a period, is a Saturday, Sunday or bank holiday, it may be done on the next working day. This applies to all Manx Acts and statutory documents, including the Income Tax Act 1970, the CbC Regulations and the Pillar Two Order, so the tool moves such dates to the next working day. A 31 December year end company return is due on 1 January, a bank holiday, so it moves to the next working day. Economic substance reporting is part of the company return for relevant sectors.

Filings and deadlines

#
#FilingWhenWhoSource
1Pillar Two registration with the Income Tax Division (one-time) Article 29: registration is due 12 months from the start of the group's first fiscal year beginning on or after 1 January 2025, or 6 months after an entity joins the group if that is later. The tool shows the group's year end (31 December 2025 for a calendar group). The Division's Pillar 2 page says the deadline is not earlier than 1 January 2026, so a calendar group may in law have until early January 2026; the earlier date is shown. Registration must also be done before any liquidation or move out of the island. Late registration penalty is GBP 250 (article 50). The DFE must also be enrolled in the online Pillar 2 Service (compulsory from 1 January 2026, and by 30 June 2026 for a DFE appointed earlier).Last day of the fiscal year (e.g. Dec 31, 2025)Every Manx constituent entity, joint venture and joint venture subsidiary of a group with consolidated revenue of EUR 750m or more in at least two of the four preceding fiscal years. The DFE registers the group.gov.im: Pillar 2 Global Minimum Tax (Order art 29)
2Company income tax return (online, form R1C) Due 12 months and one day after the end of the accounting period, and any income tax is due on the same date (pay and file). Returns must be filed online. A late return gets a fixed penalty, and a second one if still outstanding 6 months later. If the date is a weekend or bank holiday it moves to the next working day (Interpretation Act 2015 s 49(2)), so a 31 December year end return due on 1 January is due on the next working day.12 months after year end, plus 1 days (e.g. Jan 4, 2027) (moved from Jan 1, 2027, a public holiday)All companies and other corporate taxpayers (including foundations and associations) that are Manx resident, and non-resident companies with Manx source income, for each accounting period.gov.im: Pay and File
3Country-by-Country report Filed no later than 12 months and a day after the last day of the group's reporting fiscal year (regulation 8), electronically through the Online Information Providers Service in the OECD XML format. Penalty for failure: GBP 300, then up to GBP 60 a day after notice.12 months after year end, plus 1 days (e.g. Jan 4, 2027) (moved from Jan 1, 2027, a public holiday)Isle of Man resident ultimate parent entity (or surrogate or designated Manx entity) of an MNE group with consolidated revenue of EUR 750m or more in the preceding fiscal year.Income Tax (Country-by-Country Reporting) Regulations 2017, reg 8
4DTUT and MTUT returns and payment Filed by the Domestic Filing Entity through the online Pillar 2 Service, due 15 months after the fiscal year end (article 36). Payment is due on the same date (article 59). The law allows 18 months, but only for a group's first liable year and only if it has not been required to file a GloBE Information Return anywhere else in an earlier year, so most groups already in scope elsewhere get 15 months. Early date shown. For a 31 December 2025 year end the Division confirms 31 March 2027. Late return penalty GBP 250 and a further GBP 250 after 6 months, then 10% of unpaid tax at 12 months and again at 24 months. Interest on late tax is 5% a year. The Division is still building the online return function. The tool tests only the revenue figure; DTUT also has a de minimis exclusion (average revenue under EUR 10m and average profit under EUR 1m).15 months after year end (e.g. Mar 31, 2027)Groups with consolidated revenue of EUR 750m or more in at least two of the four preceding fiscal years that have a Manx entity (DTUT) or a Manx ultimate or intermediate parent (MTUT).Global Minimum Tax (Pillar Two) Order 2024, arts 33, 34, 36, 59 (consolidated)
5GloBE Information Return or notification of filing elsewhere Same date as the DTUT and MTUT returns (article 36): 15 months after the fiscal year end, or 18 months for the group's first liable year under the conditions in the Order. If the GloBE Information Return was filed in a country with a qualifying competent authority agreement with the Isle of Man, the DFE files a short notification naming that entity and country instead (articles 31 and 32). A group registered but below the EUR 750m test files a below-threshold notification by the same date (article 35). Late penalty GBP 500 (GIR) or GBP 250 (notification), repeated after 6 months. With DTUT and MTUT returns and payment (e.g. Mar 31, 2027)The Domestic Filing Entity of a registered group within scope of the GloBE Rules.Global Minimum Tax (Pillar Two) Order 2024, arts 31, 32, 35, 36
6CbC notification (Isle of Man reporting entity, first year only) Notify once, no later than 6 months after the last day of the group's first reporting fiscal year, by completing the Information Provider Service registration form (regulation 6(1)). A Manx constituent entity that is not the reporting entity names the reporting entity and its tax residence in its company income tax return, no later than one year and a day after the end of the group's reporting fiscal year (regulation 6(2)). If the company's return is due later than that because its year end differs from the group's, the Division asks the company to contact the Assessor.See noteAn Isle of Man resident constituent entity that is the ultimate or surrogate parent entity of an MNE group with consolidated revenue of EUR 750m or more.Income Tax (Country-by-Country Reporting) Regulations 2017, reg 6
