The law
#Greece applies the arm's length principle in article 50 of the Income Tax Code (ITC, Law 4172/2013). If related persons deal on terms that independent parties would not use, the profit that was not made because of those terms is added to the taxable profit (art. 50(1)). The rule is applied and read in line with the OECD principles and guidelines (art. 50(2)). Article 51 covers the transfer of functions. The documentation rules are in the Tax Procedure Code (TPC, Law 5104/2024, which replaced Law 4987/2022 and before that Law 4174/2013), art. 25. Advance pricing is in art. 26 TPC.
Documentation
#Related persons with dealings under art. 50 ITC, or transfers of functions under art. 51, must keep a Documentation File of a master file and a Greek file (art. 25(1) TPC). They are exempt if the dealings total up to EUR 100,000 a year and turnover is up to EUR 5m, or total up to EUR 200,000 and turnover is above EUR 5m (art. 25(2)). The files must be ready by the end of the corporate income tax return deadline, and a Summary Information Table is filed electronically in the same deadline (art. 25(3)). The file is kept at the registered seat and handed over within 30 days of a request (art. 25(4)). Its content is set by decision POL.1097/2014 (Government Gazette B' 883/2014) as amended by POL.1144/2014 (B' 1374/2014).
Methods
#POL.1097/2014 lists the comparable uncontrolled price, resale price, cost plus, transactional net margin and profit split methods. The traditional methods are preferred, and the transactional methods may be used with reasons if comparable data is missing. Internal and external comparables are allowed, and any database may be used if it is named in the file. The arm's length range is the interquartile range: the lowest and highest 25% of values are dropped, and any value from the 25th to the 75th percentile is accepted with adequate justification. The decision points to the OECD Guidelines as updated from time to time.
Penalties
#A late or inaccurate Summary Information Table is fined 1/1000 of the covered dealings, from EUR 500 to EUR 2,000, and a missing one from EUR 2,500 to EUR 10,000 (art. 55(1)(a) and (b) TPC). If the Documentation File is handed over on days 31 to 60 after a request the fine is EUR 5,000, on days 61 to 90 it is EUR 10,000, and later or never it is EUR 20,000 (art. 55(1)(c)). A transfer pricing adjustment also carries the inaccurate return fine of 10%, 25% or 50% of the extra tax, depending on its size (art. 54 TPC). A missing CbC report is fined EUR 20,000, and a late or inaccurate one EUR 10,000 (art. 56(1)(a)). A late return with no tax due is fined EUR 100, and a late tax return otherwise EUR 250 or EUR 500, depending on the bookkeeping system (art. 53(1) and (2), as amended by Law 5301/2026). The same art. 53 fines apply to late or missing Pillar Two returns and notices (A.1131/2026, A.1055/2026).
Pillar Two
#Law 5100/2024 (Government Gazette A' 49) applies EU Directive 2022/2523 to Greek entities of groups with revenue of at least EUR 750m in two of the four prior years (art. 3). The IIR and the domestic top-up tax apply to fiscal years starting on or after 31 December 2023, and the UTPR (arts. 13 to 15) to years starting on or after 31 December 2024 (art. 69). The GIR is filed with the AADE within 15 months of year end, or 18 months for the transitional year (art. 48(7)). If it is filed abroad instead, the Greek entity files a notification naming the filer by the same date (art. 48(4); decision A.1055/2026). The top-up tax return is due by the last working day of the month after the GIR month, and the tax is paid in one payment by the last working day of the month after that (art. 49). For year ends up to 31 March 2025, AADE decision A.1131/2026 moved the GIR and the notification to 30 October 2026, and the AADE FAQ moved the top-up tax return to 30 November 2026.
Other rules
#Groups with consolidated revenue of at least EUR 750m file the CbC report within 12 months of year end (art. 9AA Law 4170/2013), and every Greek entity notifies the AADE by the last day of the reporting year (art. 4 Law 4490/2017). Under art. 7(1) TPC, a deadline set by tax law that falls on a Saturday, Sunday or public holiday moves to the next day the tax office is open, so the tool rolls weekend and holiday dates forward. Deadlines set as a 'last working day' are listed as exact dates instead. Greek Orthodox Easter moves each year, so Good Friday, Easter Monday and Holy Spirit Monday change with it (Good Friday is 30 April 2027). Greece also has the DAC6 mandatory disclosure rules (art. 9AB Law 4170/2013) and advance pricing agreements (art. 26 TPC, unilateral decisions within 18 months, valid up to 4 years). The corporate return has been extended by AADE decision in recent years, with 24 July 2026 the latest.
Filings and deadlines
#| # | Filing | When | Who | Source |
|---|---|---|---|---|
| 1 | CbC notification to the AADE (γνωστοποίηση) Each Greek entity tells the AADE by the last day of the group's reporting year whether it is the ultimate or surrogate parent, or names the reporting entity and its tax residence (art. 4 Law 4490/2017). It is made in the AADE online notification application (POL.1341/2019). The tool shows the last day itself and does not move it off a weekend, so file before then. | Last day of the fiscal year (e.g. Dec 31, 2025) | Greek constituent entities of groups with consolidated revenue of at least EUR 750m in the year before the reporting year. | Art. 4 Law 4490/2017 (Government Gazette A' 150/2017) |
| 2 | Corporate income tax return (form N, δήλωση φορολογίας εισοδήματος νομικών προσώπων) Filed electronically by 15 July of the next year for a 31 December year end, or by the last working day of the 6th month after year end for any other year end (art. 68(2) ITC, as replaced by Law 5162/2024 art. 85). A 15 July that falls on a weekend or public holiday moves to the next working day (art. 7(1) TPC). The tool lists exact working days for year ends in 2024 to 2030. AADE extended the 31 December return by one-off decision in each recent year (21 July 2025 by A.1094/2025, 24 July 2026 by A.1140/2026), usually only days before the deadline, so plan for 15 July. | Extended: one-off AADE decisions for 31 December year ends: 21 July 2025 (A.1094/2025) and 24 July 2026 (A.1140/2026), not a standing right (e.g. Jul 24, 2026); original due date Jul 15, 2026 | All Greek legal persons and legal entities, and Greek permanent establishments of foreign companies. | Law 5162/2024 art. 85, replacing art. 68(2) ITC (Government Gazette A' 198/2024) |
| 3 | Summary Information Table (Συνοπτικός Πίνακας Πληροφοριών) Filed electronically with the AADE for each tax year in which the exemption does not apply, within the corporate income tax return deadline (art. 25(3) TPC). The tool applies the lower EUR 100,000 test, so check the EUR 200,000 limit if turnover is above EUR 5m. Fine: 1/1000 of the covered dealings if late or inaccurate (EUR 500 to 2,000), or EUR 2,500 to 10,000 if not filed (art. 55(1)(a) and (b) TPC). | With Corporate income tax return (form N, δήλωση φορολογίας εισοδήματος νομικών προσώπων) (extended) (e.g. Jul 24, 2026); original due date Jul 15, 2026 | Related persons (and Greek permanent establishments of foreign firms, or Greek firms with foreign permanent establishments) whose intra-group dealings are above EUR 100,000 per tax year when turnover is up to EUR 5m, or above EUR 200,000 when turnover is over EUR 5m (art. 25(2) TPC). Amounts are added together across all dealings. | Art. 25 Tax Procedure Code, Law 5104/2024 (Government Gazette A' 58/2024) |
| 4 | Master file (Βασικός Φάκελος Τεκμηρίωσης, part of the Documentation File) The Documentation File, made of the master file and the Greek file as the case may be, must be ready by the end of the income tax return deadline (art. 25(3) TPC). It is kept at the registered seat for the whole record keeping period and is not filed. It must be handed over within 30 days of a request (art. 25(4)). Content and accepted methods are set by decision POL.1097/2014 as amended by POL.1144/2014. | Art. 25 Tax Procedure Code, Law 5104/2024 (Government Gazette A' 58/2024) |
| 5 | Greek file (Ελληνικός Φάκελος Τεκμηρίωσης, part of the Documentation File) Prepared by the end of the income tax return deadline and kept at the registered seat (art. 25(3) and (4) TPC). An existing file can be reused for the next year if it is updated within four months of the end of the year in which a change arose (art. 25(5)). Entities under the old Law 89/1967 regime are exempt (art. 25(6)). | Art. 25 Tax Procedure Code, Law 5104/2024 (Government Gazette A' 58/2024) |
| 6 | Country-by-country report (Έκθεση ανά Χώρα) Filed as an XML file through the AADE online CbC application within 12 months after the last day of the group's reporting year (art. 9AA(1) Law 4170/2013, art. 6 Law 4490/2017). Fine: EUR 20,000 if not filed, EUR 10,000 if late or inaccurate (art. 56(1)(a) TPC). | 12 months after year end (e.g. Dec 31, 2026) | Greek ultimate parent of a group with consolidated revenue of at least EUR 750m, or a Greek entity that must file as the surrogate or local filing entity. | Art. 9AA Law 4170/2013, added by Law 4484/2017 (Government Gazette A' 110/2017) |
| 7 | GloBE Information Return (Δήλωση Πληροφοριών Συμπληρωματικού Φόρου, DAC9/GIR) Filed electronically through the AADE GIR platform no later than 15 months after the fiscal year end, or 18 months for the group's transitional year, its first year in scope (art. 48(7) and 48(1)(c) Law 5100/2024; A.1131/2026 art. 3). No Greek filing is needed if the parent or a designated entity files in a country that exchanges the return with Greece; the Greek entity then files the notification instead. AADE decision A.1131/2026 moved the date to 30 October 2026 for year ends up to 31 March 2025 (turn on extended dates to see it). Late or missing returns are fined under art. 53 TPC. | 15 months after year end (e.g. Mar 31, 2027) | Greek constituent entities of groups with consolidated revenue of at least EUR 750m in at least two of the four preceding fiscal years. | Art. 48 Law 5100/2024 (Government Gazette A' 49/2024) and AADE decision A.1131/2026 (B' 3921/2026) |
| 8 | Notification of the filing entity (γνωστοποίηση, Decision A.1055/2026) The Greek entity, or the designated local entity if there are several, names the entity that files the GIR and its jurisdiction (art. 48(4) Law 5100/2024). It is filed in myAADE by the GIR deadline: 15 months after year end, or 18 months for the transitional year (A.1055/2026 art. 3, Government Gazette B' 1367/2026), and 30 October 2026 for year ends up to 31 March 2025 (A.1131/2026 art. 5(2)). It does not need to be filed again in a later year if nothing has changed. Late or missing notices are fined under art. 53 TPC. | With GloBE Information Return (Δήλωση Πληροφοριών Συμπληρωματικού Φόρου, DAC9/GIR) (e.g. Mar 31, 2027) | Greek constituent entities of groups with consolidated revenue of at least EUR 750m in at least two of the four preceding fiscal years, when the GIR is filed outside Greece by the parent or a designated filing entity. Not needed when the GIR is filed in Greece (AADE FAQ, 9 July 2026, question 4). | AADE decision A.1055/2026 (Government Gazette B' 1367/2026) |
| 9 | Top-up tax return of the constituent entities (δήλωση συμπληρωματικού φόρου) Due by the last working day of the month after the month in which the GIR is filed (art. 49(2) Law 5100/2024). The tool counts from the GIR due date, as the AADE FAQ does; if you file the GIR earlier, the return may be due earlier. The AADE FAQ of 9 July 2026 (question 5) says returns for year ends up to 31 March 2025 are due by 30 November 2026, because A.1131/2026 moved the GIR to 30 October 2026 (turn on extended dates to see it). The tool lists exact working days for year ends in 2024 to 2030. | Last working day of the month after the GIR month (art. 49(2) Law 5100/2024) (e.g. Apr 29, 2027) | Greek constituent entities liable for IIR, UTPR or qualified domestic top-up tax. | Art. 49 Law 5100/2024 (Government Gazette A' 49/2024) |
| 10 | Top-up tax payment (single payment) The tax is paid in one amount by the last working day of the month after the final date for the top-up tax return (art. 49(3) Law 5100/2024). For year ends up to 31 March 2025 the return date moved to 30 November 2026, so the payment works out to 31 December 2026; no AADE text states this payment date directly (turn on extended dates to see it). The tool lists exact working days for year ends in 2024 to 2030. | Last working day of the month after the top-up tax return deadline (art. 49(3) Law 5100/2024) (e.g. May 31, 2027) | Greek constituent entities liable for IIR, UTPR or qualified domestic top-up tax. | Art. 49 Law 5100/2024 (Government Gazette A' 49/2024) |
| 11 | Handing over the Documentation File on a tax office request The file must be given to the tax administration within 30 days of receiving the request (art. 25(4) TPC). Fine: EUR 5,000 if given on days 31 to 60, EUR 10,000 on days 61 to 90, and EUR 20,000 after day 90 or if never given (art. 55(1)(c)). | Within 30 days of a tax authority request | Related persons (and Greek permanent establishments of foreign firms, or Greek firms with foreign permanent establishments) whose intra-group dealings are above EUR 100,000 per tax year when turnover is up to EUR 5m, or above EUR 200,000 when turnover is over EUR 5m (art. 25(2) TPC). Amounts are added together across all dealings. | Art. 25(4) and 55(1)(c) Tax Procedure Code, Law 5104/2024 (Government Gazette A' 58/2024) |
