The law
#Chile applies the arm's length principle in article 41 E of the Income Tax Law (Ley sobre Impuesto a la Renta, DL 824). The SII can challenge the prices, values or profits of cross-border dealings with related parties abroad, or set them if none was set. It also covers business reorganisations that move functions, assets, risks or activities in or out of Chile. Parties are related if one takes part directly or indirectly in the management, control, capital, profits or income of the other, or the same people do so in both. A branch or permanent establishment is related to its head office. Dealings with any party in a preferential tax jurisdiction (article 41 H) count as related, whether or not it is in the same group. Law 21.713 widened and tightened these rules from 1 November 2024 (art. 41 E No. 1 and No. 4).
Documentation
#The statute does not require a stand-alone local file with a due date. A taxpayer may attach a transfer pricing study and must keep all support available, including data of the foreign related parties (art. 41 E No. 3). The SII instead requires four annual sworn statements under art. 41 E No. 6. DJ 1907 is the transfer pricing return: it is due from companies the SII classes as medium or large that deal with foreign related parties, and from any other taxpayer whose foreign related party dealings exceed CLP 500m. DJ 1937 is the CbC report from a Chilean parent of a group with revenue of EUR 750m or more, or from a Chilean group entity named as the single substitute filer. DJ 1950 is the master file, filed by the same Chilean parent. DJ 1951 is the local file, filed by large companies whose group files a CbC report and that have foreign related party dealings above CLP 200m. All four are due on 30 June, which the SII confirms each year (Res. Ex. 135 of 2026 for 2027). Any filer that files between 1 July and 30 September is treated as having used the one-time 3-month extension (Res. Ex. 64 of 2024), which also lengthens the SII audit period. The master and local file papers go in the SII electronic file, in Spanish or English.
Methods
#Art. 41 E No. 2 lists six methods: comparable uncontrolled price, resale price, cost plus, profit split, transactional net margin, and residual (other) methods. Residual methods are only for cases where the first five cannot be applied, and the taxpayer must justify why. There is no strict order. The taxpayer picks the most appropriate method, looking at the pros and cons of each, data, comparables, the tested party, the number of years used and comparability adjustments. If there are two or more comparable results, an interquartile range must be used. A result outside the range is not at arm's length. When the SII issues an assessment the adjustment goes to the median. If the taxpayer accepts the SII's analysis, the adjustment can go to a single figure or any point in the range that is agreed. Taxpayers may self-adjust upward before the SII asks (No. 9), and may ask for advance pricing agreements (No. 7) and corresponding adjustments (No. 8).
Penalties
#A missing, wrong, incomplete or late sworn statement under art. 41 E No. 6 is fined 10 to 50 UTA (annual tax units). The fine cannot exceed the higher of 15% of the taxpayer's own capital or 5% of its effective capital. A maliciously false statement falls under Tax Code art. 97 No. 4, which has a fine of 100% to 300% of the tax avoided and prison. A transfer pricing adjustment is taxed only with the 40% single tax in the first paragraph of LIR art. 21, plus a 5% fine on the difference unless the taxpayer gave the SII the requested papers on time during the audit (No. 4). Interest also applies. The adjustment has no effect on other taxes such as VAT. A late filing of the annual return is fined 10% of the tax, plus 2% per month after 5 months, up to 30% (Tax Code art. 97 No. 2).
Pillar Two
#Chile has not enacted Pillar Two. There is no GloBE, income inclusion rule, UTPR or domestic top-up tax law. Law 21.850, published on 17 October 2026, cuts the corporate rate but contains no minimum tax rules, and no Pillar Two bill appears among the bills Ley Chile links to the Income Tax Law. There are no Pillar Two filings or deadlines for Chile.
Other rules
#The annual income tax return (Form 22) is filed in April for the previous calendar year (LIR art. 65 No. 1 and art. 69), so 30 April, with Chile's tax year set as the calendar year. Companies that close their books in June file in October (art. 69 No. 1), which is not modelled. Deadlines in months move to the next business day when they end on a Saturday, Sunday or holiday (Tax Code art. 10), and tax return and payment dates that fall on a holiday, a Saturday or 31 December move to the next business day (art. 36), so rollWeekends is true. The SII dates for the four sworn statements are already set on a working day and are not moved. Chile also has a thin capitalisation tax of 35% on excess related party debt (art. 41 F), a CFC regime (art. 41 G) and a preferential regime list (art. 41 H). Under Law 21.850 the first category tax rate for companies in the general regime is 27% for 2026, 25.5% for 2027, 24% for 2028 and 23% from 2029. When the SII audits, it first cites the taxpayer under Tax Code art. 63, and the taxpayer has one month to answer, extendable once by up to one month.
Filings and deadlines
#| # | Filing | When | Who | Source |
|---|---|---|---|---|
| 1 | Annual income tax return (Declaración Anual de Impuesto a la Renta, Formulario 22) Filed in the month of April for the income of the previous calendar year (LIR art. 65 No. 1 and art. 69), so 30 April 2027 for the 2026 year. If 30 April is a Saturday, Sunday or holiday, the next business day applies (Tax Code art. 10 and 36). The SII has in some years accepted returns with no tax to pay or with a refund until early May, but plan on 30 April. A late return is fined 10% of the tax plus 2% a month after 5 months, up to 30% (Tax Code art. 97 No. 2). Companies with a June year end file in October (art. 69 No. 1), which is not modelled here. | Fixed calendar date (e.g. Apr 30, 2026) | All first category taxpayers that keep full accounting, including companies and branches. Companies are taxed on the calendar year in Chile. | LIR art. 69 (Biblioteca del Congreso Nacional) |
| 2 | Notice naming a substitute filer for the CbC report (aviso de delegación, Anexo 5 of Res. Ex. 126) A taxpayer that must file the CbC report may delegate it to one entity in the multinational group. The notice is filed at the Regional Directorate for the Chilean parent's jurisdiction within the 30 calendar days before the DJ 1937 deadline (Res. Ex. 126 of 2016, item 5), so the tool shows the last working day before the due date. Res. Ex. 108 of 2019 and Res. Ex. 101 of 2020 amended Res. Ex. 126 but left item 5 in place. When a foreign parent delegates to a Chilean entity, that entity must tell the SII in the same period. Chile has no other CbC notification. Other CbC messages go to consultascbc@sii.cl (item 6). | Last working day before the DJ 1937 due date (the notice goes in the 30 calendar days before that date) (e.g. Jun 26, 2026) | Only a group that delegates its CbC filing to one Chilean group entity. Not required of every group. The tool flags every group at or above EUR 750m, so ignore it if no entity is named as the substitute. | SII Res. Ex. 126 of 2016, items 5 and 6 (sii.cl) |
| 3 | Annual transfer pricing sworn statement (DJ 1907, Declaración Jurada Anual sobre Precios de Transferencia) Due on 30 June of the year after the year reported, 30 June 2026 for 2025 and 30 June 2027 for 2026 (SII Res. Ex. 123 of 2025 and Res. Ex. 135 of 2026). The base rule is the last working day of June (Res. Ex. 126 of 2016, Res. Ex. 101 of 2020). Filing between 1 July and 30 September is treated as the one extension of up to 3 months allowed by LIR art. 41 E No. 6, and the SII lists the taxpayers covered in October (Res. Ex. 64 of 2024). The extension also lengthens the SII audit period by the same time. The extended date is 30 September. In 2028 that is a Saturday, so the tool shows Friday 29 September rather than rolling it forward. A missing, wrong, incomplete or late statement is fined 10 to 50 UTA, up to the higher of 15% of own capital or 5% of effective capital. A new form layout applies from the 2025 business year (Res. Ex. 104 of 2025). | Extended: 3-month extension for any filer that files between 1 July and 30 September (SII Res. Ex. 64 of 2024, under LIR art. 41 E No. 6) (e.g. Sep 30, 2026); original due date Jun 30, 2026 | Taxpayers the SII classes as medium or large companies at 31 December that dealt with related parties outside Chile in the year (any amount), and any other taxpayer whose foreign related party dealings together exceed CLP 500m (including dealings with parties in an art. 41 H jurisdiction). The tool tests for any foreign related party dealing, so it can flag a small taxpayer that is in fact below CLP 500m. | SII Res. Ex. 135 of 2 October 2026, due dates for tax year 2027 (sii.cl) |
| 4 | Country-by-country report (DJ 1937, Reporte País por País) Same date as DJ 1907: 30 June of the year after the year reported, with the same automatic extension to 30 September (Res. Ex. 126 of 2016, Res. Ex. 108 of 2019, Res. Ex. 64 of 2024). Amounts are in Chilean pesos, converted at the Banco Central rate on the last day of December. It is a separate return from DJ 1907 since Res. Ex. 101 of 2020. The report is exchanged with treaty partners. Penalties are the same as for DJ 1907: 10 to 50 UTA, or Tax Code art. 97 No. 4 if maliciously false. | With Annual transfer pricing sworn statement (DJ 1907, Declaración Jurada Anual sobre Precios de Transferencia) (extended) (e.g. Sep 30, 2026); original due date Jun 30, 2026 | The ultimate parent entity of a group that is tax resident in Chile, when group consolidated revenue is at least EUR 750m (converted at the 1 January 2015 Banco Central rate of CLP 738.05 per EUR), or a Chilean group entity named as the single substitute for the parent. A Chilean subsidiary of a foreign group does not file DJ 1937 unless it is the named substitute. | SII Res. Ex. 126 of 2016 and Res. Ex. 108 of 2019 (sii.cl) |
| 5 | Master file sworn statement (DJ 1950, Declaración Jurada Anual Archivo Maestro) Due with DJ 1907 on 30 June of the year after the year reported, extendable to 30 September (Res. Ex. 101 of 2020, items 1, 3 and 6; Res. Ex. 64 of 2024). The form is filed in the SII online sworn statements menu, and the descriptive annex (Annex 3) and its documents go in the SII electronic file (Mis Expedientes) at the same time. Documents may be in Spanish or in English. Blank or wrong documents are treated as not filed (Tax Code art. 8 No. 16). A missing, wrong or late filing is fined 10 to 50 UTA (LIR art. 41 E No. 6; SII Circular 29 of 2022). | With Annual transfer pricing sworn statement (DJ 1907, Declaración Jurada Anual sobre Precios de Transferencia) (extended) (e.g. Sep 30, 2026); original due date Jun 30, 2026 | The Chilean ultimate parent of a group with total revenue of at least EUR 750m at 31 December (at the 1 January 2015 Banco Central rate), or the Chilean entity named as the single substitute for the parent for the CbC report (Res. Ex. 101 of 2020, item 1). | SII Res. Ex. 101 of 2020 (sii.cl) |
| 6 | Local file sworn statement (DJ 1951, Declaración Jurada Anual Archivo Local) Due with DJ 1907 on 30 June of the year after the year reported, extendable to 30 September. Only individual dealings above CLP 200m are listed, except loans and other financing, which are listed whatever the amount (SII instructions for DJ 1951). The descriptive annex (Annex 6) and its documents go in the SII electronic file at the same time, in Spanish or English. A missing, wrong or late filing is fined 10 to 50 UTA. | With Annual transfer pricing sworn statement (DJ 1907, Declaración Jurada Anual sobre Precios de Transferencia) (extended) (e.g. Sep 30, 2026); original due date Jun 30, 2026 | A taxpayer that, at 31 December, meets all three tests: it is in the SII large company segment (Res. Ex. 76 of 2017), its group parent had to file a CbC report in Chile or abroad, and it had dealings with foreign related parties above CLP 200m (Res. Ex. 101 of 2020, item 2). The tool tests group revenue of EUR 750m and total foreign related party dealings above CLP 200m, and cannot test the large company segment. | SII Res. Ex. 101 of 2020 (sii.cl) |
| 7 | Transfer pricing support requested in an SII audit (citación, Tax Code art. 63) Before challenging prices, the SII must cite the taxpayer under Tax Code art. 63 to bring all support that shows the dealings were at normal market prices (LIR art. 41 E No. 2). The taxpayer has one month to answer, and may ask once for up to one month more. The support kept under art. 41 E No. 3 should be ready, including data of the foreign related parties. A 5% fine on the adjustment is avoided if the requested papers were given on time (art. 41 E No. 4). | Within 30 days of a tax authority request | Any taxpayer with dealings with related parties abroad that the SII chooses to audit. | Tax Code art. 63 (Biblioteca del Congreso Nacional) |
