The law
#Kazakhstan's transfer pricing rules are in the Law on Transfer Pricing No. 67-IV of 5 July 2008. The new Tax Code (Law No. 214-VIII of 18 July 2025, in force from 1 January 2026) did not take the rules in. It only points to the Law (art. 176). The Law controls international business operations, meaning deals where one side is a non-resident and the other a Kazakh resident or permanent establishment. It also controls some domestic deals tied to them: sales of minerals, deals where a party has tax benefits or a loss in the two prior years, and deals between parties with different CIT rates (art. 3). The arm's length principle is defined in art. 2(12). Related parties are defined in art. 11 (affiliates, holders of 10% or more, and others). Law No. 215-VIII of 18 July 2025 changed arts. 6, 7-2 and 7-3 from 1 January 2026.
Documentation
#There are three kinds of reports. The local file is filed with the tax authority within 12 months after the reporting financial year (31 December for a calendar year). It applies to a company with related party deals that are under control and prior year revenue of at least 5,000,000 times the monthly calculation index (MCI) in force on 1 January of the year before the reporting year (art. 7-1). The master file is given only on request, within 30 calendar days, and cannot be requested earlier than 12 months after the group's year end (art. 7-2). It applies when group revenue is at least EUR 750m, or the threshold set by the parent's country. The CbC report is filed by a Kazakh parent or authorised member within 12 months after the group's year end. Other Kazakh members file it on request in certain cases (art. 7-3). Every member of an international group, of any size, files a statement of participation by 1 September of the year after the reporting year (art. 5-1). Separately, taxpayers with listed international deals (certain goods, services and loans) above 250,000 MCI file a TP monitoring report by 15 May (Monitoring Rules, Order No. 176). Any deal participant must give price support documents within 30 days of a request (art. 5(3)).
Methods
#Art. 12 lists five methods: comparable uncontrolled price, cost plus, resale price, profit split and net profit. The comparable price method comes first. If it cannot be used, the method that gives the best reasoned result is chosen, based on a functional analysis, data quality and comparability. The authority works with ranges of prices, margins or profitability (arts. 17-1 and 17-2). For related party deals, an adjustment is made to the median of the range after a tax audit (art. 10(5-1)). Some deals (tax haven parties, barter, loss makers, tax benefit holders) are adjusted to the median without waiting for a range test. Exchange traded goods follow quoted prices.
Penalties
#Under Administrative Offences Code art. 273, a late or missing TP monitoring report or refusal to give requested documents brings a fine of 100 MCI for small businesses, 200 MCI for medium and 350 MCI for large businesses. A repeat offence within a year costs 125, 250 or 750 MCI. A late, missing, wrong or incomplete TP report (local, master, CbC) or participation statement brings a fine of 250 MCI for medium and 500 MCI for large businesses, doubled on repeat within a year (500 and 1,000 MCI). A gap of over 2,000 MCI between the monitoring report and audit results brings 100, 200 or 300 MCI. After an adjustment, tax, fines and late payment interest apply (art. 10(6)). Corrected reports can be filed at any time and are not tied to the deadlines (art. 7(3)).
Pillar Two
#Kazakhstan has not enacted Pillar Two. The Tax Code in force from 1 January 2026 (text on adilet.zan.kz as of 22 October 2026) has no global minimum tax, domestic top-up tax, income inclusion rule or undertaxed profits rule, so no Kazakh Pillar Two return or payment is due and no deadline is shown. Kazakh entities of large groups can still be covered by the income inclusion or undertaxed profits rules of other countries. Advisers report that the government has looked at the subject to tax rule first (a draft resolution on signing the related multilateral convention was put out for comment in July 2024).
Other rules
#The corporate income tax (CIT) tax year is the calendar year (Tax Code art. 358). The CIT return is due by 31 March of the next year and the balance of tax by 10 April (arts. 359(1) and 347(2)). The Tax Code says a last day that falls on a non-working day moves to the next working day (art. 64(2)), and the Monitoring Rules say the same (rule 6). The TP Law has no such rule, so the local file, master file, CbC report and group statement dates are shown as set. The Law and the Rules are published in Kazakh and Russian.

A last day on a non-working day moves to the next working day (rule 6). The authority may extend the date by up to six months if its own software has technical errors (rule 4); on 4 May 2026 it used this power for 2025 reports, which are now due by 15 November 2026 (a Sunday, so 16 November under rule 6), and said no fines apply for delay caused by the system not being ready. Late filing brings a fine of up to 350 MCI (Administrative Offences Code art. 273(1)). New forms apply from the 2025 report (Order No. 782 of 17 Dec 2025; annexes amended by Order No. 618 of 14 Sep 2026). | Extended: KGD announcement of 4 May 2026 under Monitoring Rule 4: 2025 reports due by 15 November 2026 (new forms not yet open in the filing system) (e.g. Nov 16, 2026); original due date May 15, 2026 (moved from Nov 15, 2026, a Sunday) | Taxpayers with international business operations on the official monitoring list (certain oil and gas, goods, services and loans), where total income, expenses or liabilities on those deals in the year reach 250,000 MCI at the MCI in force on 1 January of the reporting year (KZT 983m for 2025 at an MCI of KZT 3,932; about KZT 1.08bn for 2026 at KZT 4,325. The tool uses the lower 2025 figure). Related and unrelated parties alike. No report is filed if there were no such deals. | Order of the Minister of Finance No. 176 of 16 Mar 2015, Rules for monitoring transactions (as amended) |

The Law has no weekend rule for this date, so the calendar date is shown. A corrected report can be filed at any time (art. 7(3)). Late, missing or wrong reports bring a fine of 250 MCI (medium) or 500 MCI (large) (Administrative Offences Code art. 273(4)). Forms and fill-in rules are set by the authority. | 12 months after year end (e.g. Dec 31, 2026) | Participants in controlled deals with related parties in the reporting year, whose revenue in the prior year was at least 5,000,000 MCI at the MCI on 1 January of the year before the reporting year (about KZT 18.5bn for 2025 at an MCI of KZT 3,692; about KZT 19.7bn for 2026). Parties that are related only through the economic dependence tests in art. 11(2) points 16 to 20 (use of the other party's intangibles, over 50% of inputs or sales, debt over 50% of equity, agent or distributor status) do not count. | Law No. 67-IV on Transfer Pricing art. 7-1 |
| 6 | Country-by-country report (межстрановая отчетность) The Kazakh parent or authorised member files no later than 12 months after the end of the reporting financial year (art. 7-3(1)), so 31 December of the next year for a calendar year. Other members file within 12 months of receiving a request. A notarised copy of the foreign parent's report satisfies the duty. The Law has no weekend rule for this date. Late, missing or wrong reports bring a fine of 250 MCI (medium) or 500 MCI (large). There is no separate CbC notification; the statement of participation (1 September) is listed as its own row. | 12 months after year end (e.g. Dec 31, 2026) | A Kazakh ultimate parent of a group with consolidated revenue of at least EUR 750m (at the average official exchange rate for the year) in the prior financial year, or a member it authorises. Other Kazakh members and permanent establishments file only if asked, when the parent has no filing duty or no exchange agreement, or has failed to file or exchange. For foreign parents the threshold is the one their own country sets. | Law No. 67-IV on Transfer Pricing art. 7-3 |
| 7 | Master file (основная отчетность), given on request There is no annual filing date. The authority may ask for the file no earlier than 12 months after the group's year end, and the member must give it within 30 calendar days of receiving the request (art. 7-2(1)). A notarised copy of the foreign parent's master file satisfies the duty. Late or missing files bring a fine of 250 MCI (medium) or 500 MCI (large) (Administrative Offences Code art. 273(4)). | Within 30 days of a tax authority request | Members of an international group that had controlled deals in the year, where group consolidated revenue in the prior year was at least EUR 750m (Kazakh parent), or the threshold the parent's country sets for CbC reporting (foreign parent). | 8 | Give price support documents on request On the authority's request, a deal participant gives the information and documents that support the price within 30 calendar days of receiving the request (art. 5(3)(4)). During an audit, the economic justification of the price is given when the authority asks (art. 5(3)(5)). Refusing to give documents brings a fine of 100, 200 or 350 MCI by business size (Administrative Offences Code art. 273(1)). | Within 30 days of a tax authority request | Any participant in a controlled transaction (international business operation or linked domestic deal). | Law No. 67-IV on Transfer Pricing art. 5(3) |
