The law
#Hungary sets the arm's length rule in section 18 of the Corporate Tax Act (Act LXXXI of 1996, Tao.). If related parties use a price different from the arm's length price, the taxpayer must raise or lower its pre-tax profit by the difference. A downward adjustment is only allowed if the other party signs a document and confirms it counts the same amount in its own tax base (s. 18(1)). Section 3(2) of the Act on the Rules of Taxation (Art., Act CL of 2017) also says such deals are taxed at the arm's length price. The documentation rules are in NGM Decree 45/2025 (XII. 23.), in force from 24 January 2026 and used first for tax years that start in 2026. It replaced NGM Decree 32/2017 (X. 18.). For tax years that start in 2025 the old decree still applies unless the taxpayer chooses the new one for some local files (s. 15 of the new decree).
Documentation
#Every company that is not a small enterprise on the last day of the tax year must record the arm's length price, the method and the supporting facts by the time it files its corporate tax return (Tao. s. 18(5)). Small enterprises are exempt, and a micro enterprise counts as small. Medium-sized companies are not exempt. State-majority-owned companies and public-benefit non-profit companies are also outside the rule. For tax years that start in 2026 or later, a local file is needed for each related transaction (or pooled group of transactions) above HUF 150 million at arm's length without VAT (decree s. 4(4)), and a master file is needed only if all transactions that need a local file add up to more than HUF 500 million (s. 4(3)). For tax years that started in 2025 the old decree still applies: the local file limit is HUF 100 million, and a company that needs any local file also needs a master file (old decree s. 1(2) e) and s. 4(1)). Simplified local files exist for low value-adding services and a few other cases. Documents may be in Hungarian, English or German, the local file must be kept at least 8 years, and the records can be amended until a tax audit starts (s. 4(8) to (10)). Separately, the company reports data on each reportable related transaction in its corporate tax return (the ATP-01 and ATP-KV sheets). Under the new decree the data duty does not apply to transactions of HUF 150 million or less.
Methods
#Section 18(2) lists five methods plus a catch-all: comparable price, resale price, cost plus, transactional net margin, profit split, and another method if none of the five works. The OECD Guidelines are the stated model for the decree. When public or checkable database data are used, the taxpayer must narrow the result to the interquartile range (s. 18(9)). A price inside the range needs no adjustment. A price outside the range is moved to the median, unless the taxpayer shows that another value in the range fits better (s. 18(11) and (12)). Decree section 11 sets rules for database searches: independent and active companies only, three years of data, screening for loss makers, and a local search first, then wider Central and Eastern Europe. The screen must be refreshed every three years and the financial data every year.
Penalties
#Failing to prepare or keep a transfer pricing record can bring a default penalty of up to HUF 5 million per record (per pooled record), and up to HUF 10 million per record for a repeat breach (Art. s. 230(1)). If the same record is missed again the fine can reach four times the first fine, unless more than two years passed between the two failures (s. 230(2) and (3)). The fine can be reduced or waived if the record is made before the decision on the repeat breach is delivered. A failure to report the transfer pricing data in the return is probably covered by the general default penalty of up to HUF 1 million for companies (Art. s. 220), but this was not confirmed. A late, wrong or missing CbC report or CbC notification can be fined up to HUF 20 million under the CbC Act (s. 43/S). Pillar Two filings can be fined HUF 5 million for a missing or late notification and HUF 10 million for a missing, late or wrong return or data report (Art. s. 227/B), but no fine applies for tax years that start before 31 December 2026 if the group acted as could be expected (Art. s. 274/R).
Pillar Two
#The global minimum tax is in Act LXXXIV of 2023 (the Act LV of 2024 only amended it, for example by adding the advance payment). It covers groups with revenue of at least EUR 750 million in at least two of the four previous years (s. 1(2)). It has a qualified domestic top-up tax (QDMTT) and the IIR from tax years that begin after 31 December 2023, and the UTPR from tax years that begin after 31 December 2024 (s. 53). Each Hungarian group member (or one designated local entity) must notify NAV by the last day of the second month after the year end (s. 44(1)). It then files one electronic return and data report on the NAV form (24GLBADO for 2024, 25GLBADO for 2025) within 15 months after the year end, and pays the tax in the same period (s. 44(9) and (10)). That is 31 March 2027 for calendar 2025. The deadline is 18 months for the transition year, which is the first year the group falls under the Act for Hungary (s. 49 and s. 3 point 15), so 30 June 2026 for calendar 2024. NAV says the tax for a transition year is also paid within the 18 months. A separate QDMTT advance return and payment is due on the 20th day of the 11th month counted from the year end (s. 44(11)). NAV confirms this is 20 November 2026 for calendar 2025. If the group report is filed abroad under a qualifying agreement, the Hungarian entity must name the filer and the place of filing within six months of that filing (s. 44(4)).
Other rules
#Groups with consolidated revenue of at least EUR 750 million file a country-by-country report with NAV within 12 months after the end of the reporting year if the ultimate parent is a Hungarian tax resident, or if a Hungarian group member must step in (Act XXXVII of 2013 s. 43/N). Every Hungarian group member must also notify NAV by the last day of the reporting year whether it is the parent, the surrogate parent or neither, and say who files (s. 43/O). Tax authority rulings on the arm's length price (APAs) are available on request under Art. ss. 174 to 183, with a HUF 10 million fee for a unilateral and HUF 14 million for a bilateral or multilateral procedure. The corporate tax return and the tax are due on the last day of the fifth month after the tax year, so 31 May for a calendar year. There is no separate annual TP form: the data goes into the return.
Filings and deadlines
#| # | Filing | When | Who | Source |
|---|---|---|---|---|
| 1 | CbC notification to NAV (bejelentés) Each Hungarian group member tells NAV by the last day of the group's reporting year its name, seat and tax number, whether it is the ultimate parent, the surrogate parent or a group member that must report, the group's name and the year end (Act XXXVII of 2013 s. 43/O(1)). If it is none of these it names the reporting entity and its country (s. 43/O(2)). Changes must be reported within 30 days (s. 43/O(3)). The date is the last day of the year itself and is not moved for weekends, because the duty must be met by the end of that year. Penalty up to HUF 20 million (s. 43/S). | Last day of the fiscal year (e.g. Dec 31, 2025) | Hungarian group members of groups with consolidated revenue of at least EUR 750 million in the year before the reporting year (or the HUF equivalent at the MNB January 2015 average rate). | Act XXXVII of 2013 s. 43/O (Nemzeti Jogszabálytár) |
| 2 | Pillar Two notification of supplementary taxpayer status (bejelentés) Due on the last day of the second month after the tax year end, on the NAV form, with group data and the data in s. 44(5) a) and b) (Act LXXXIV of 2023 s. 44(1)). For a calendar year that is the end of February of the next year. Penalty HUF 5 million (Art. s. 227/B(1)), but no fine for tax years that start before 31 December 2026 if the group acted as expected (Art. s. 274/R). Under section 52(4) of the Air. a deadline that falls on a day the tax authority does not work moves to the next working day. | 2 months after year end (e.g. Mar 2, 2026) (moved from Feb 28, 2026, a Saturday) | Hungarian group members (or one designated local entity for all of them) of groups with revenue of at least EUR 750 million in at least two of the four preceding years. | Act LXXXIV of 2023 s. 44(1) (Nemzeti Jogszabálytár) |
| 3 | Local file (helyi dokumentum) Must be ready by the time the corporate tax return is filed (Tao. s. 18(5)), so by the return due date, 31 May for a calendar year. It is not filed with NAV but must be shown when asked. Penalty up to HUF 5 million per record (Art. s. 230). Shown without a weekend move, because the file is prepared and not filed. | 5 months after year end (e.g. May 31, 2026) (a Sunday: may move to the next working day) | Any company that is not a small enterprise on the last day of the tax year, for each related transaction (or pooled transactions) above HUF 150 million a year at arm's length without VAT. Smaller transactions, transactions covered by a Hungarian price ruling, qualifying cost recharges up to HUF 500 million, stock exchange deals, official-price deals and deals with private individuals are exempt (decree s. 4(4)). For tax years that started in 2025 the old decree applies (unless the taxpayer chose the new one for some local files), and its limit is HUF 100 million (old NGM Decree 32/2017 s. 1(2) e)). The tool uses the HUF 150 million figure. | Tao. s. 18(5) and NGM Decree 45/2025 s. 4 |
| 4 | Corporate income tax return (társasági adóbevallás) Due on the last day of the fifth month after the tax year, so 31 May for a calendar year (Art. Annex 2, part I.B point 2.4). The tax is due the same day (Art. Annex 3 point 3.2.1). The return is filed electronically and carries the transfer pricing data report. Under section 52(4) of the Air. a deadline that falls on a day the tax authority does not work moves to the next working day. No standing extension was found. | 5 months after year end (e.g. Jun 1, 2026) (moved from May 31, 2026, a Sunday) | All corporate tax payers that file a full return. Some non-profit bodies file a declaration instead (Tao.). | Art. Annex 2, part I.B point 2.4 (Nemzeti Jogszabálytár) |
| 5 | Transfer pricing data report in the corporate tax return (ATP-01 and ATP-KV sheets) Reported inside the annual corporate tax return, so it follows the return deadline (Tao. s. 18(5), decree ss. 12 and 13). Exempt stock exchange and official-price deals are reported only above HUF 500 million, and some deals need only part of the data (decree s. 12(3) to (5)). NAV calls the records duty and the data duty two separate obligations. | With Corporate income tax return (társasági adóbevallás) (e.g. Jun 1, 2026) (moved from May 31, 2026, a Sunday) | Same group of taxpayers as the records duty. Data is reported for each related transaction with performance in the year, except transactions of HUF 150 million or less at arm's length without VAT (decree s. 12(2)). For tax years that started in 2025 the old HUF 100 million limit applies. | Tao. s. 18(5), NGM Decree 45/2025 ss. 12 and 13, and NAV FAQ on TP data reporting |
| 6 | Qualified domestic top-up tax advance return and payment (elismert belföldi kiegészítő adó előleg) The advance is the expected qualified domestic top-up tax for the year. It is due by the 20th day of the 11th month counted from the last day of the tax year (Act LXXXIV of 2023 s. 44(11)), so 20 November 2026 for calendar 2025, as NAV confirms. It is filed on the same NAV form as the final return (25GLBADO for 2025). It applies from the tax year beginning in 2024 (s. 53(5)). No late-payment surcharge, penalty or fine applies if the group acted as can be expected (s. 44(14)). Under section 52(4) of the Air. a deadline that falls on a day the tax authority does not work moves to the next working day. | Day 20 of the 11th month after year end (e.g. Nov 20, 2026) | Hungarian group members (or the designated local entity) of in-scope groups. Filed even if no top-up tax is expected, according to secondary sources. | NAV notice on form 25GLBADO (21 October 2026) and Act LXXXIV of 2023 s. 44(11) to (14) |
| 7 | Master file (fődokumentum) Must be ready by the time the corporate tax return is filed (Tao. s. 18(5)). If the data are not yet available because the group's parent must prepare its own master file later, the deadline follows the parent's deadline, but no later than 12 months after the year end (decree s. 5(2)). If the company leaves the scope of the Tao. it must prepare the master file by the date of its return. Penalty up to HUF 5 million per record (Art. s. 230). Not filed with NAV, so no weekend move is shown. | Extended: when the group's ultimate parent has a later deadline for its own master file; never later than 12 months after the taxpayer's year end (decree s. 5(2)) (e.g. Dec 31, 2026); original due date May 31, 2026 | Any company that is not a small enterprise, if its related transactions that need a local file add up to more than HUF 500 million in the tax year (decree s. 4(3)). For tax years that started in 2025 the old decree applies: a company that needs any local file (over HUF 100 million) must also prepare a master file (old NGM Decree 32/2017 s. 4(1)). The tool uses the HUF 500 million figure from the new decree. | NGM Decree 45/2025 s. 4(3) and s. 5(2) |
| 8 | Country-by-country report (országonkénti jelentés) Filed electronically with NAV within 12 months from the last day of the reporting year (Act XXXVII of 2013 s. 43/N(8) and s. 43/R). A late, wrong or missing report can be fined up to HUF 20 million (s. 43/S), unless the filer shows it acted as can be expected. Under section 52(4) of the Air. a deadline that falls on a day the tax authority does not work moves to the next working day. | 12 months after year end (e.g. Dec 31, 2026) | Ultimate parent that is a Hungarian tax resident, or a Hungarian group member that must file because the parent state does not require or exchange the report, for groups with consolidated revenue of at least EUR 750 million in the year before the reporting year. | Act XXXVII of 2013 s. 43/N (Nemzeti Jogszabálytár) |
| 9 | Global minimum tax return and payment (kiegészítő adó bevallás, form 24GLBADO and later versions) One electronic filing on the NAV form (through ONYA) covers the top-up tax return and the data report, and the tax must be paid in the same period: 15 months after the year end (Act LXXXIV of 2023 s. 44(9) and (10)), so 31 March 2027 for calendar 2025. The transition year, the first year the group falls under the Act for Hungary, gets 18 months (s. 49), so 30 June 2026 for calendar 2024. NAV says the tax is also paid within those 18 months. A group that came into scope later has its own transition year, which this tool cannot tell. Penalty HUF 10 million (Art. s. 227/B), but no fine for tax years that start before 31 December 2026 if the group acted as expected (Art. s. 274/R). Under section 52(4) of the Air. a deadline that falls on a day the tax authority does not work moves to the next working day. | 15 months after year end (e.g. Mar 31, 2027) | Hungarian group members (or the designated local entity) of groups with revenue of at least EUR 750 million in at least two of the four preceding years. | Act LXXXIV of 2023 s. 44 and s. 49, and NAV notice on form 25GLBADO (21 October 2026) |
| 10 | GloBE information return (data report inside the supplementary tax filing) Hungary has no separate GIR deadline. The data report is part of the same filing and has the same deadline, 15 months, or 18 months for the transition year (s. 44(2) and (9), s. 49). If it is filed abroad, the Hungarian entity must report the filer and place of filing within six months of that filing (s. 44(3) and (4)). | With Global minimum tax return and payment (kiegészítő adó bevallás, form 24GLBADO and later versions) (e.g. Mar 31, 2027) | Same groups as the return. Not needed if the ultimate parent or a designated filing entity files it in a state that has a qualifying competent authority agreement with Hungary. | Act LXXXIV of 2023 s. 44(2) to (9) (Nemzeti Jogszabálytár) |
| 11 | Notice of the entity that files the GIR abroad (adatszolgáltatást teljesítő csoporttag azonosítása) Due within six months after the data report was submitted abroad (Act LXXXIV of 2023 s. 44(4)). It names the filing group member and the place of filing. The date depends on the foreign filing date, so it has no fixed rule here. | See note | Hungarian group members of in-scope groups whose supplementary tax data report is filed in another state under a qualifying competent authority agreement. | Act LXXXIV of 2023 s. 44(3) and (4) (Nemzeti Jogszabálytár) |
